A domestic worker is only entitled to family responsibility leave if he/she:

  • has been employed for more than four calendar months; and
  • works for at least four days a week.

At the request of a domestic worker, an employer must grant at least five days paid family responsibility leave during each twelve-month cycle of employment when:

  • the domestic worker’s child is sick; or
  • in the event of the death of the domestic worker’s spouse, life partner, parent, adoptive parent, grandparent, child, adopted child, grandchild or sibling.

A domestic worker may take family responsibility leave in respect of a day or part of a day and payment for family responsibility leave must be made on the normal pay day. Before making payment, an employer may require reasonable proof of the above (i.e. death certificate / medical certificate).
